FLAGSTAFF — The retrial of accused Northern Arizona University shooter Steven Jones won’t happen in October because a member of his defense team is medically unable to proceed to trial at that time.
Coconino County Superior Court Judge Dan Slayton on Wednesday set a new trial date for March 27, 2018, despite objections from prosecutor Ammon Barker.
The trial had been scheduled to begin Oct. 10 after being postponed once in August.
Slayton also said there were offers made by the Coconino County Attorney’s Office that would have “significantly reduced the exposure Mr. Jones would suffer if he proceeded to trial.” But Slayton said that “Mr. Jones, acting on the advice of counsel, has decidedto reject the offer and proceed to trial.”
The terms of the potential plea deals were not disclosed.

Because it pertained to personal information regarding one of the case attorneys, Wednesday’s hearing was held behind closed doors in the judge’s chambers. Barker and Slayton were present in chambers. Jones and his attorneys attended telephonically. A reporter was allowed to attend the end of the hearing when the judge put on the record his decision to postpone the trial.
Barker declined comment afterward.
Attorneys for Jones were not immediately available for comment.
Jones, who remains free pending his retrial, was charged with first-degree murder and aggravated assault after an October 2015 shooting on the NAU campus that left one student dead and three others seriously wounded.

Last April, a Coconino County jury was unable to reach a unanimous verdict on whether Jones, 20, attacked the other students or if he was acting in self defense.
In August, defense attorneys Joshua Davidson and Burges McCowan filed a motion to disqualify the prosecutor’s office. They argued that before he was elected county attorney in November 2016, William Ring was an employee of the Flagstaff law firm Aspey, Watkins & Diesel, which donated to his campaign.
The principal attorneys at that firm, Louis Diesel and Frederick Aspey, have filed a civil lawsuit against Jones and his family on behalf of the parents of Colin Brough, who was killed in the shooting, and Nick Piring and Nick Prato, two of the three students wounded.
Barker, the prosecutor, said that “the defense has offered up some insinuations and nothing more” and that the perceived conflict “exists only in the minds of imaginative lawyers.”
Slayton last month denied the motion to disqualify the prosecutor’s office, but invited defense attorneys to take his decision to the Arizona Court of Appeals because he felt the circumstances were unique and there was no case law to guide his ruling.
